TERMS & CONDITIONS
Effective Date: January 1st, 2026
PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THIS WEBSITE. By using this website, you signify your consent to these terms of use. If you do not agree to these Terms of Use, please do not use the website.
These Terms & Conditions (“Terms”) govern your access to and use of https://pathtune.io (the “Site”) and your purchase or use of products and services offered by Axiom Concepts LLC, doing business as PathTune (“PathTune,” “we,” “us,” or “our”). By accessing or using the Site or purchasing or using a PathTune product or service, you agree to these Terms. If you do not agree, do not use the Site or purchase our offerings.
1. ABOUT PATHTUNE AND THESE TERMS
PathTune offers books and ebooks, downloadable resources, assessments, audio practices, online courses, coaching, educational programs, and may offer live or virtual events, workshops, retreats, and other services.
These Terms apply generally to the Site and our offerings. A sales page, checkout page, event registration page, coaching agreement, course agreement, or other written offer may contain additional terms for a particular product or service, including scope, price, payment schedule, access period, schedule, cancellation rules, refund terms, and participant requirements. Those specific terms supplement these Terms and control on matters they expressly address if there is a conflict. Mandatory rights under applicable law are not waived.
2. ELIGIBILITY AND ACCEPTABLE USE
You may use the Site and purchase offerings only if you can form a binding agreement under applicable law. If you are under the age of majority where you live, you may use the Site or purchase an offering only with the involvement and permission of a parent or legal guardian where permitted by law. Particular courses, coaching programs, or events may have additional age or eligibility requirements stated with the offer.
You agree to provide accurate information when ordering, registering, or communicating with us. You must not use the Site or our offerings for unlawful purposes; attempt unauthorized access to the Site or its systems; interfere with their operation, security, or availability; upload, transmit, introduce, or distribute malware, spyware, viruses, ransomware, or other malicious or harmful code; impersonate another person; harass, threaten, or abuse others; infringe another person’s rights; or use our offerings in a way that violates these Terms.
We may remove unlawful or infringing material, restrict access, suspend participation, or take other reasonable action when necessary to address security risks, misuse, unlawful activity, or a material breach of these Terms, subject to applicable law.
3. PRODUCTS, SERVICES, PRICING, AND PAYMENTS
The applicable sales or registration page will describe the product or service, included materials, access method, schedule, price, and important conditions. Offerings may include one-time purchases, coaching packages, courses, event registrations, payment plans, or subscriptions.
Unless an offer clearly identifies recurring billing or a payment plan and discloses the amounts, timing, duration, and applicable cancellation terms before purchase, a displayed price is a one-time charge.
By submitting an order, you authorize the disclosed charge to your selected payment method and represent that you are authorized to use it. Payments are processed by the payment provider presented at checkout. Applicable taxes or other charges will be disclosed or handled as required by law. Optional add-ons will be identified as optional and separately priced before you authorize the purchase.
We may correct material pricing or listing errors, decline an order, or cancel a transaction when reasonably necessary to prevent suspected fraud, comply with law, or address an unavailable offering. If we cancel an order after collecting payment, we will refund the amount collected for the canceled portion of the order. We will not convert a one-time purchase into a recurring charge without the disclosure and authorization required by applicable law.
4. DIGITAL PRODUCTS, DELIVERY, AND ACCESS
Digital products may include ebooks, downloadable files, audio, assessments, worksheets, online courses, recorded lessons, and companion resources. Delivery and access instructions will be provided on the applicable offer page, at checkout, by email, or after purchase.
You are responsible for providing an accurate email address and maintaining access to it. If you do not receive an expected delivery or cannot access a purchased item, contact [email protected].
Access duration, download limits, updates, included support, and any course-platform access period will be stated in the applicable offer. Unless expressly included, a digital purchase does not include a printed book, personal coaching, one-to-one support, live access to the author, or future products.
We may make reasonable updates to educational content, but we will not intentionally remove a material paid feature in a manner inconsistent with the offer or applicable law. You are responsible for having compatible devices, software, internet access, and other technology reasonably needed to access a product. We do not guarantee that every file or platform will work with every device or configuration, but we will make reasonable efforts to address material access issues.
5. COACHING, COURSES, AND EDUCATIONAL PROGRAMS
Coaching, courses, group programs, and other educational services may include calls, meetings, lessons, exercises, feedback, community access, or other elements described in the relevant offer. The offer or a separate agreement may specify the scope of services, duration, payment schedule, session scheduling, rescheduling, missed sessions, access period, participant responsibilities, and cancellation or refund terms.
Coaching and educational programs are collaborative processes. You remain responsible for your own decisions, actions, well-being, relationships, business activities, and results. We do not promise that participation will produce a particular personal, professional, financial, or other outcome.
You agree to participate respectfully and not to misuse, distribute, or record program materials or other participants’ contributions without permission. You may not share another participant’s personal information, stories, or private communications outside a group or program without that participant’s permission, except where disclosure is legally required.
PathTune coaching and educational offerings are not psychotherapy, mental-health treatment, medical care, crisis support, legal advice, investment advice, or tax or accounting advice. Participation does not create a therapist-patient, doctor-patient, attorney-client, or other regulated professional relationship. Seek qualified professional care or advice when appropriate. Do not use a coaching session, course, group, email, or text exchange as a substitute for emergency or crisis services.
Where a separate signed coaching or program agreement applies, it governs the specific services and commercial terms covered by that agreement. These general Terms continue to apply to the Site and other matters not replaced by the separate agreement.
6. LIVE AND VIRTUAL EVENTS
PathTune may offer live, in-person, or virtual events, workshops, retreats, or other gatherings. Event-specific details will be provided at registration, including price, date, format, included items, participation requirements, and any event-specific cancellation, transfer, or refund policy. Review those details before registering.
If an event is canceled, rescheduled, or materially changed, we will provide any refund, credit, rescheduling option, or other remedy required by applicable law and the event-specific terms. Unless expressly stated otherwise, we are not responsible for travel, lodging, meals, lost wages, or other incidental expenses associated with an event.
You agree to behave respectfully, follow reasonable safety instructions and event rules, and avoid harassment, disruptive conduct, or conduct that creates a risk to others. We may remove a participant whose conduct materially disrupts an event or threatens the safety of others, subject to applicable law and any refund rights that apply.
Some events may be photographed, recorded, or streamed. We will provide appropriate notice when recording or photography is planned and obtain consent where required by law. Any permitted use of your image, voice, or contribution beyond ordinary event operation will be addressed through an appropriate notice or separate release where necessary. Do not record, stream, photograph, or redistribute an event or other participants’ contributions unless the organizer expressly permits it.
If an event involves physical activity, travel, a venue, or other specific risks, additional instructions, disclosures, or a separate waiver may be provided before registration or participation. This section does not waive any rights that cannot legally be waived.
7. Refunds and Money-Back Guarantees
Heart-Led Momentum Ebook: 30-Day Money-Back Guarantee. If you purchase the Heart-Led Momentum ebook directly from PathTune, you may request a refund within 30 calendar days of the purchase date by emailing [email protected].
Include your order number or the email address used at checkout so we can locate your transaction. You do not need to provide a reason for your request. For a request made within this period, we will refund the amount paid for the ebook to the original payment method. Your payment provider may require additional time to post the refund.
The ebook guarantee applies to the ebook itself.
A separately priced optional add-on, including the Navigator Collection, or any other product or service is not included unless the relevant sales page or checkout expressly states that the guarantee covers it. Any limitation on the guarantee will be disclosed with the offer.
Other Products and Services. Refunds, cancellations, transfers, or credits for optional add-ons, other digital products, courses, coaching packages, programs, subscriptions, payment plans, and events are governed by the terms disclosed on the relevant sales page, checkout, registration page, or written agreement before purchase. The ebook's 30-day guarantee does not automatically apply to those offerings unless expressly stated.
Event Cancellations. If PathTune cancels an event and does not offer a replacement date or materially equivalent alternative, we will refund the event registration fee paid to PathTune. Options for rescheduled or materially changed events will be handled according to the disclosed event terms and applicable law. Unless expressly stated otherwise, travel, lodging, meals, lost wages, and other incidental expenses are not refundable by PathTune.
Refund Processing and Digital Products. Approved refunds will generally be returned to the original payment method. Processing time may depend on the payment provider. If a digital product is refunded, the license to use that product ends, and you agree to stop using it and delete copies to the extent reasonably practicable.
Nothing in this section limits any consumer rights or remedies that cannot lawfully be excluded.
8. INTELLECTUAL PROPERTY AND PERSONAL-USE LICENSE
The Site and PathTune materials, including books, text, frameworks, product names, logos, graphics, illustrations, audio, assessments, guided practices, worksheets, course lessons, recordings, downloads, and other resources, are owned by Axiom Concepts LLC, Jaden Osborne, or their respective licensors, as applicable, and are protected by intellectual-property laws. PathTune® is a registered trademark of Jaden Osborne. Use of the trademark by PathTune does not transfer ownership of the mark to you.
When you purchase or receive a digital product, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable license to access and use the materials for your own personal, non-commercial purposes, subject to the terms of the applicable offer.
Your purchase does not transfer ownership of the materials or underlying intellectual property to you. Unless we give written permission or applicable law permits it, you may not copy, reproduce, republish, distribute, publicly display, resell, sublicense, share paid access credentials or download links, upload paid materials to public or shared repositories, remove proprietary notices, create a competing product from our protected materials, or commercially exploit the materials.
You may refer to our work and discuss your own experience, provided you do not reproduce protected content beyond what applicable law permits or misrepresent our work as your own. All rights not expressly granted are reserved.
9. COMMUNITIES, USER CONTENT, AND FEEDBACK
If an offering includes a group, community, discussion area, comment section, chat, or other interactive feature, you are responsible for content you submit and for respecting the rights and privacy of other participants. Do not submit unlawful, abusive, harassing, threatening, deceptive, or infringing content. Do not share another participant’s personal story, contact details, messages, or contributions outside the group without permission.
You retain ownership of your original feedback, suggestions, and materials you submit, except for rights you separately grant to us. You grant PathTune a non-exclusive permission to use feedback and suggestions you voluntarily provide to improve our products and services. We will not publicly attribute a private message, personal story, or identifiable testimonial to you in marketing without your permission, unless disclosure is required by law. If we ask to feature a testimonial, image, recording, or story in marketing, we will obtain permission where required and will not knowingly present it in a misleading way.
We may moderate or remove content or restrict participation when reasonably necessary to maintain safety, protect rights, comply with law, or enforce these Terms.
10. TEXT MESSAGES AND ELECTRONIC COMMUNICATIONS
PathTune may offer optional text-message programs involving personal-development prompts, resources, responses to messages you send, and updates about books, courses, programs, coaching, or events. Enrollment is voluntary and separate from purchasing a product. We will send recurring or promotional texts only when we have obtained the consent required for the applicable message program.
When you opt in, you authorize messages within the scope described in the enrollment disclosure. Message frequency varies. Message and data rates may apply. Reply STOP to opt out and HELP for help where available, or contact [email protected]. We may send a one-time confirmation that your opt-out has been processed. Carriers are not liable for delayed or undelivered messages.
Providing a phone number for an order or customer service does not, by itself, enroll you in recurring marketing texts. Acceptance of these Terms does not replace any separate consent required for text-message marketing.
We may send transactional emails related to an order, delivery, account, service, safety, or a request you made. Marketing emails will include an unsubscribe method where required by law. Unsubscribing from marketing will not necessarily stop essential transactional communications.
11. THIRD-PARTY SERVICES AND LINKS
The Site and our products may link to or rely on third-party websites and services, including payment processors, website hosts, course platforms, video-conferencing services, email and messaging providers, and event platforms or venues. Those providers may have their own terms and privacy policies. We do not control their independent services, content, policies, security, or availability.
Review relevant third-party terms and privacy policies before using those services or submitting information directly to them. This section does not release PathTune from responsibilities imposed on us by applicable law or for service providers acting on our behalf.
12. EDUCATIONAL DISCLAIMER AND NO GUARANTEED RESULTS
PathTune’s books, courses, assessments, frameworks, coaching, audio practices, events, and other content are for general educational, informational, and personal-development purposes. They are not medical care, diagnosis, mental-health treatment, psychotherapy, crisis services, legal advice, financial or investment advice, or tax or accounting advice. See our Website & Product Disclaimer for additional information.
Personal, creative, professional, business, and other outcomes vary. We do not guarantee that you will complete a particular project, change a particular habit, achieve a particular result, earn money, increase revenue, or obtain any specific outcome. Examples, stories, testimonials, and illustrations describe particular experiences and are not guarantees of typical or future results. Any timeline is a planning guideline unless a specific offer expressly promises otherwise.
Disclaimers do not replace our obligation to make truthful, supportable marketing claims.
13. WARRANTIES AND LIMITATION OF LIABILITY
To the maximum extent permitted by law, the Site and general informational content are provided on an “as available” basis. We do not warrant uninterrupted or error-free operation or that every digital resource will be compatible with every device or platform. This section does not exclude warranties or rights that cannot legally be excluded.
To the maximum extent permitted by applicable law, PathTune will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to use of the Site or our offerings. To the maximum extent permitted by law, PathTune’s total liability for a claim arising from a particular purchase will not exceed the amount you paid to PathTune for the product or service giving rise to the claim during the 12 months preceding the event giving rise to the claim.
These limits do not apply to liability that cannot legally be excluded or limited, or to other exceptions required by applicable law. Nothing in these Terms limits any non-waivable statutory rights or remedies.
14. RESPONSIBILITY FOR CERTAIN CLAIMS
To the extent permitted by law, you agree to be responsible for third-party claims, losses, and reasonable costs resulting directly from your unlawful use of the Site, your willful misconduct, your infringement of another person’s rights, or your material breach of these Terms. This provision does not require you to indemnify PathTune for PathTune’s own unlawful conduct, negligence where indemnification is not permitted, or liabilities that cannot legally be shifted to you.
15. PRIVACY
Our Privacy Policy explains how we collect, use, disclose, and retain personal information. It is available at https://pathtune.io/privacy. Any consent required for a specific use of personal information, marketing email, or text message will be obtained separately where required by law.
16. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles, except where applicable law provides otherwise.
Before initiating a formal dispute, please contact us at [email protected] and explain the concern so we can attempt to resolve it informally. This request does not suspend a legal deadline or restrict any statutory right unless applicable law allows it.
Subject to mandatory consumer-protection laws and jurisdictional requirements, disputes may be brought in a court of competent jurisdiction in Maricopa County, Arizona. Nothing in this section deprives a consumer of rights that cannot legally be waived or requires a dispute to be heard in a location prohibited by applicable law.
17. CHANGES, SEVERABILITY, AND ENTIRE AGREEMENT
We may update these Terms as our Site, products, services, or legal obligations change. The current version will be posted on the Site with an updated effective date. Changes apply prospectively unless otherwise permitted by law. A revision will not retroactively change the terms of a completed purchase without your agreement where required by law.
If a provision is found unenforceable, the remaining provisions remain in effect to the extent permitted by law. Our failure to enforce a provision is not a waiver of our right to enforce it later. These Terms, together with the applicable offer details, Privacy Policy, Disclaimer, and any separate signed agreement, constitute the agreement governing the relevant subject matter.
If a separate signed coaching, course, or event agreement conflicts with these general Terms on a matter specific to that offering, the separate agreement controls for that matter, subject to applicable law.
